Pursuant to call made under direction of the Warden the Council met. Municipal Council of the County of Welland met at the Grand Jury Room in the Court House in the Village of Welland on Tuesday the 20th day of December, A. D., 1870, at 12 o'clock noon, in special session, but for the transaction of general business nevertheless. The Warden in the Chair. MEMBERS PRESENT.-Messrs. Beckett, Betts, Brooks Members present. Buchner, Garner, Karr, Kirkpatrick, Lattimore, Learn, Sen. Learn, Jun., Lee, Rysdale, Slater, Taylor, Treble and Wynn-16. The Warden addressed the Council thanking members Warden's Address. for their prompt attendance. He mentioned that during the recess the Rev. Mr. Cooper, A Resignation. Local Superintendent of Schools for Humberstone had resigned and removed from that Township and that he the Warden had appointed the Rev. John Gribbell of same place to fill the vacancy, until the present session as provided by the statute. He also explained that the suit brought by the County Grand against the Grand Trunk R. R., with reference to the right suit. of way at Port Colborne had been decided in term against the County, but that upon the advice of Mr. Harrison, Q. C., Trunk �4 the legal adviser of the County in this matter the case had been carried to the Court of Appeal and would be argued there on the 8th January next. Gaol Repairs. The Warden further mentioned that the Committee on Gaol Repairs had found it necessary to direct some devia- tions from the strict letter of the specifications all of which could be more fully shewn by the architect if the Council desire to hear him on the subject. The Warden concluded by laying on the table a copy of Grand Jury Presentment. the presentment of the Grand Jury adopted at the Septem- ber sittings of the Court of Assize in this County; also County Carleton. A circular from the Warden of the County of Carleton asking aid from this County to the sufferers by the late extraordinary fires in that County; also Prison Inspeo- A Circular from J. W. AN ACT to confirm By-Law Number 244 of the Township of Thorold. WHEREAS the Corporation of the Township of Thorold �19 did on the Twenty-Eight day of May, A. D. 1870, pass a certain By-law intituled, "A By-law for the stopping up and conveyancing of certain road allowances in the Township of Thorold" which By-law is in the words and figures following, that is to say: Whereas, a public road has been opened across lot number One Hundred and Ten in the Township of Thor old, in lieu of the original road allowances, or parts of road allowances hereinafter mentioned, for which public road no compensation has been paid; and Whereas Edward Gardiner, a Deputy Provincial Land Surveyor has reported in writing to the Municipal Council of the Township of Thorold that said public or new road is sufficient for the purposes of a public road or Highway. Be it therefore Enacted by the Corporation of the Township of Thorold, and it is hereby Enacted, 1st. That the original road allowances or parts of road allowances in the said Township hereinafter mentioned be stopped up and closed, and that they be conveyed to the party or parties hereinafter mentioned, being the party through whose lands the same run, in lieu of the said new road. 2d. That the original Road Allowance between lots One Hundred and Thirty-Three, and One Hundred and Ten, and the south part seven chains and thirty-one links of the original road allowance between lots numbers One Hundred and Ten and One Hundred and Eleven, part of the original road allowance, links between three and and the north three chains and thirty lots numbers One Hundred One Hundred and Thirty-four; and also, Thirty- the east part of the original road allowance between lots numbers One Hundred and Eleven and One Hundred and Thirty- four, one chain and ten links, all of the Township of Thorold, in the County of Welland, be conveyed to James Brooks of the Township of Thorold, yeoman, in lieu of the road across the south part of lot number One Hundred and Ten. 3rd.-That before the said above original road allowances are conveyed in lieu to the above named party they shall �20 reserve to the said Township the full width of at least Sixty-six feet of all fences on the above mentioned new or laid out road in such manner as shall be approved by the Council of said Township. 4th. WHEREAS the Corporation of the Township of Bertie did, on the Thirtieth day of April, A. D., 1870, pass a certain By-law intituled, "By-law authorizing the sale of the original allowances for road between lots numbers Sixteen and Seventeen, in the first and second Concessions, L. E, of this Township," which By-law is in the words and figures following, that is to say: Whereas 16 and the allowance 17, in the for road between lots 1st and 2nd Concessions, numbers L. E., of the Township of Bertie, is not required for a public highway on account of another road near said allowance for road having been made and used as a public highway instead thereof. And Whereas Henry Rathbone, John Jansen, James S. Graham and John B. Hershey, whose lands adjoin said allowance for road having made application to this Coun cil for the purchase thereof: And Whereas the requisite notice having been posted up and published in accordance with the 323 section of the Municipal Institutions of Upper Canada. Therefore the Council of the Corporation of the Township of Bertie enacts as follows: 1st. That the Reeve be and he is hereby empowered, authorized and required for and in behalf of the Corporation of the Township of Bertie to execute a Deed of Conveyance to Henry Rathbone, John Jansen, James S. Gra- ham and John B. Hershey, for those certain portions of the original allowance for road lying and being situated between lots Nos. 16 and 17, in the 1st and 2nd Concessions, L. E., of this Township, for such quantity thereof, as immediately adjoins each of the respectively for above named parties lands and in consideration of the above named parties paying or causing to be paid unto the Treasurer of this Corporation the rate of Twenty-five Dollars of lawful money of Canada per acre, for that said certain quantity of �22 said original allowance for road so adjoining their said lands respectively. 2nd. That the Treasurer be and he is hereby authorized and required to pay or cause to be paid to Jonathan Sex smith the rate of Twenty-five Dollars per acre for the lands now occupied by the public traveled road, which said road has been taken from lots No. 16, and in the 1s and 2nd Concessions, L. E., instead of the original allow ance for road, which said lots are now owned by the said Jonathan Sexsmith, on condition that said Jonathan Sex smith shall execute or cause to be executed a Deed of Con- veyance to the Corporation of the Township of Bertie for the new public traveled road which shall not be of a less width than the original allowance for road. WHEREAS the Corporporation of the Township of Pel. ham did, on the 27th day of August, A. D., 1870, pass a cer tain By-law, intituled, "An Act to authorize the convey- ance to Johnson Swayze and Henry Laws of certain por. tions of the original allowance for road lands, in lieu of the public traveled adjoining their road running across their said lands," which By-law is in the words and figures following, that is to say: Whereas Johnson Swayze and Henry Laws by their Petition now before this Council have made application for the passing of a By-law to authorize the conveyance to them of so much of the original allowance for road in front of lots 4, 5 and 6, in the Third Concession of the said Township, as is not occupied as a public highway in lieu of the public traveled road running across lot 4 in the Second Concession, owned by the said Johnson Swayze, and across parts of lots 5 and 6, in the Third Concession, owned by the said Henry Laws-the said traveled road being near the line of the said road allowance: and Whereas, having considered the matter and having heard the said parties in support of their said application as well as Messrs. John Sanderson and Conrad Miller, parties claiming to be prejudicially affected by the passing of the said By-law: And Whereas due proof having been submitted of the publication of the requisite notices in that behalf, this Council deems it right and expedient to grant the prayer of the said Petition, and upon a report under the hand of Henry Lawe a duly qualified Deputy Provincial Land Surveyor, setting forth that the said traveled road is sufficient for the pur poses of a public highway, have decided to pass this said By-law in furtherance thereof. Your Committee agreed with Mr. Ladshaw for his ser- vices as Superintendent for the sum of $400, which sum is to cover and include his charge for plans and specifications prepared by him. Council Room, December 21, 1870. �31 REPORT OF COMMITTEE ON COUNTY LANDS. To the Warden and Councillors for the County of Welland: The Committee on Marsh Lands beg to submit their First Report. That at the June Session of 1869 a grant of $1,000 was made by your Honorable Council for the enlargement of the back ditch, South side the Feeder, from the culverts below Marshville, westward, in 1869, $505 of that sum was expended, leaving $495 which sum has been expended during present year. The work was commenced a short distance East of Lot 19 and is completed the west side of Lot 29, being a distance miles; the ditch is finished to Five feet and finished to of over three bottom and in the opinion of Your Committee will be of great benefit to the settlers whose lands are greatly benefitted thereby. The parties whose lands adjoin having paid in money and labor the sum of $500, in conformity with conditions on which the grant was made by your Honorable Council. The County Land Tract runs about One and One quarter of a mile further west from where the ditch is completed and in justice to the parties owning Lots 30, 31, 32 and 33, on the line of this back ditch, the same should be finished to western boundary Lot 33 on line of said back ditch, the cost of which will be about $150. Your Committee recom- mend that a further grant of $100 be made by your Honorable Council toward completing the same on the same conditions as former grant, the parties to be benefitted to pay or perform work to the value of $50. In regard to appropriation of two-thirds of $200 made by your Honorable Council for improving the back ditch, north side of Feeder, $66,94, has been expended; the amount appropriated will be insufficient to complete the same to the point contemplated by your Committee Your Committee would therefore recommend a further grant of your Honorable Council of $50 on same conditions of previous grants, that the parties interested, pay or perform work to the value of $25. Your Committee recommend the Warden's cheque being �82 issued for $576,78, being total amount expended on both ditches the present year. The following lands are liable for apportionment of ex- penses across the lands and recommend the same being collected in the taxes of 1871, in conformity with By-law of this Council in that behalf. To the Warden and Councillors for the County of Welland in Council Assembled: The Report of the Road and Bridge Committee, HUMBLY SHEWETH, That in connection with a select Committee appointed by the Council of Lincoln, your Committee gave the contract for the rebuilding of Jones' Bridge on the River Welland, on the County Line between this County and the County of Lincoln to Mr. Isaac N. Michiner for the price or sum of Seven Hundred and Fifty Dollars, the one half thereof to be paid by this County, the other half to be paid by Lincoln, and that the bridge has been fully completed according to contract. Your Committee further report that at the time of acceptance of the bridge Mr. Michiner offered to build the ap proaches to the bridge on each side for the sum of One Hundred and Sixty Dollars. �37 Your Committee were willing to agree with him at that price and to pay one half that sum-the Committee of Lincoln were unwilling and did not consent. Your Committee then built the approach on the Wain fleet side at a cost of $60, and the County of Lincoln have built the approach on the Gainsborough side at a cost to them of $150. Your Committee would recommend that cheques be issued to the proper parties for the sums for which this County is liable as follows: The sum of Four Hundred and Ninety-five Dollars and Forty-two cents, being one half of the cost of said bridge and approaches. Three Hundred and Ninety-five Dollars 85-100 of this amount has already been paid by order of the Chairman, leaving a balance of Ninety-nine Dollars 15-100 yet to be paid. With regard to O'Reily's bridge which was let to Abraham Chapman for One Hundred and Twenty-five Dollars, this sum has been paid by Chairman's order. All of which is respectfully submitted. M. I do not ask or intend at any time to ask payment from the County for any of the furniture placed in that room-I respectfully ask to be permitted to occupy the room for the purposes of this Council as County Clerk, with the right to remove the furniture-all of which being my own property, whenever I may desire to do so. SIR, I am directed to instruct you for the information and guidance of the Council, that the "Ontario Institution for the education of the Deaf and Dumb, Belleville," will be opened for the reception of pupils on Tuesday the 18th October proximo. I would most respectfully call the attention of the Coun cil to Section 7 of the By-law herewith annexed, which provides that parents, guardians or friends who are unable to pay for the board of pupils, shall make application to the Councils of the County, Township, City, Town, or Incor porated Village in which they reside, and admission to the Institution will be awarded to such pupils on the Munici pality becoming responsible to the institution for payment of board in accordance with the terms set forth in Sections 5 and 6 of said By-law. In conformity with the requirements of "The Prison and Asylum Inspection Act 1868," The Inspector of Asylums, Prisons, &c., enacts as follows:CAP. I. DESIGN OF INSTITUTION. I. The Institution is founded for the purpose of impart �41 ing general education, as "well as instruction in some professional or manual art to such deaf mutes residing in the Province of Ontario, as are hereafter described, and is not intended as an Asylum for the aged and infirm, or a Hospital for the treatment of disease; but in its design has reference only to the physical, mental and moral training of deaf mute youths of both sexes. CAP. II. ADMISSION AND DISCHARGE OF PUPILS. I. All deaf mute youths of both sexes between the ages of seven and nineteen. not being deficient in intellect, and free from contagious disease, being residents of the Province of Ontario shall be admitted into the Institution. 1I. The period of education and instruction for any pupil, shall not exceed seven years, and no pupil shall remain in the Institution after the age of twenty-one, unless under special circumstances, discretionary power in this respect to be vested in the Inspector and Principal: III. The regular annual School Session shall commence on the first Wednesday in September each year, and shall continue till the last Wednesday in June, and applications for admission must be made in good time to ensure the pupil reception at the commencement of the Session. After the first year no applications for admission will be received after the first Wednesday in September, except in special and extraordinary cases. IV. Education as well as instruction in such mechanical manual employments as may be inaugurated in the Insti- tution, including books, stationery, maps, and all school appliances, together with bed, bedding, towels. and general maintenance, (excepting only wearing apparel and food) to be free to all youths specified in Sec. II. of this by-law. V. Parents, guardians, or friends who are able to pay for the board of pupils will be charged the cost of food only, which amount will be determined and fixed at the beginning of each Session, half of which amount shall be paid in advance, and the other half before the close of the Session. �42 VI. The cost of board for the opening Session is hereby fixed at the rate of six dollars per month, commencing from the date of admission of the pupil, but in all future Sessions the cost of board will be charged for the full annual school term between the first Wednesday in September and the last Wednesday in June, and no deduction will be made from this charge in consequence of absence or any other cause whatever, except sickness. VII. Parents, guardians or friends, who are unable to pay the above amount for the board of pupils, shall apply to the councils of the county, township, city, town, or in corporated village in which they reside, and the clerk of the municipality shall make application to the Inspector or Principal for the admission of such pupils into the institution; and the admission will be awarded on the munici pality becoming responsible for board, in accordance with terms stated in sections 4 and 5. The whole question in respect to the inability of the applicants to pay, to be deter mined by such municipality, without reference to the Gov ernment or the officers of the institution. VIII. Parents, guardians or friends, who are able to pay for the board of pupils, will make direct application to the principal for admission into the institution. IX. Indigent children without parents to be boarded, clothed and educated at the expense of the Government, on the application for admission of the municipal corporation in which the orphan resides, with the certificate of the warden, reeve or mayor, and the county judge, attached. Travelling expenses of such pupils, to and from the institu tion, to be defrayed by such municipality. X. Pupils residing out of the Province may be received into the institution, and entitled to all its benefits at the rate of $125 per annum, payable semi-annually in advance, for board, lodging and education, provided there is vacant accommodation. XI. It is required that the pupils sent to the institution shall be decently and comfortably clothed, and furnished with a sufficient change and variety of apparels to ensure cleanliness and comfort. �43 The name of the boy or girl to be written on each article with permanent marking ink. XII. The vacation will commence on the last Wednesday in June, and end on the first Wednesday in September, during which time every pupil must be removed to his or her home or place of abode. XIII. All travelling expenses of pupils to or from the Institution, whether at vacation, or in consequence ofserious sickness, must be defrayed by the parent, guardian, friend or municipality sending such pupil. XIV. CLENCH, County Clerk, Lincoln: PRESENTMENT OF GRAND JURY. The Grand Jury for Our Sovereign Lady the Queen on their oath present, That they have examined the jail and have found it throughout cleanly and in good order so far as the officials are concerned, but they found the roof of the day room of the basement in rather a dilapidated condition. The plas- ter being partially off and lathing loose. The Grand Jury further present, That they found as prisoners three men who have been confined for four months, charged as being Fenian spies, but no proceedings have been taken against them up to this time. The Grand Jury would therefore respectfully urge that proceedings should be taken against them with- out much further or unnecessary delay as an act of justice as well to the prisoners as to the County; they being a source of expense thereto. The Grand Jury further represent, That they also found a woman who has very lately been incarcerated, and who is a raving maniac-and the Grand Jury think that such person who is so grievously afflicted is not a proper inmate of a jail. They therefore recom- mend that her removal to an asylum be as speedy as possible. �47 The Grand Jury further present, That some of the prisoners did complain to the Jury of their dietary, but on examination the Jury found that the rules had been complied with. That is the daily dietary rules, but in the general rules relating thereto, there is a discretion given to vary the diet, and it is this want of variation that the prisoners complain of, but the Jury must expressly mention that no fault in this matter can be found with the officials, as they were informed by the Sheriffthat there is a Committee appointed by the County Council called the Jail Committee who exercise the power of providing supplies for the jail, and such articles as such Com- mittee have furnished have been given-but the Jury would respectfully recommend that where a prisoner has been sick or in debilitated health some better fare would be desirable: The Grand Jury further present, That great fault has been found by the Judge and by others engaged in the professional business of the Court, of the great noise caused by the people walking in the Court room, there being no covering over the floor. The Jury therefore urge as a duty incumbent on the County immediately to remedy this by ordering and causing mat ting or some other suitable article to be laid down along the several passages, and the other walking spaces in the Court Room. AN ACT to appropriate a sum of Money in aid of the suffering Poor in Nova Scotia. WHEREAS there is evidence before this Council, that many Fishermen in Nova Scotia, owing to the failure of fish to catch during the past season, and many other poor persons are in a suffering condition for want of food, and the interests of humanity require that this Council do something towards relieving such suffering. Be it therefore Enacted, by the Corporation of the County of Welland, and it is hereby Enacted, That the sum of One Hundred Dollars be appropriated out of the County Funds in aid of the suffering poor in Nova Scotia, before mentioned, and that the Warden do issue his Cheque on the Treasurer for the said sum in favor of such persons as may be entitled to receive the same. Your Committee being informed that several persons in Humberstone and Wainfleet, are complaining of sustaining damages, owing to the insufficiency of County Drains and want of proper outlets to carry off the water, Your Com- mittee would recommend that full power be given to Marsh Lands Committee to make all necessary enquiry as to the cause of these complaints, and if they deem it necessary, that they instruct the County Engineer to take levels and make estimates of expense in securing best Drainage to meet requirements of these complaints, and the improve- ment of County Lands generally. Your Committee also recommend that full power be given to said Committee to carry out the recommendations of Report of Marsh Lands Committee. adopted by Your Honorable Council on 19th December last, and this Council will sustain said Committee in what they shall have done, and that the Warden be authorized to issue a cheque monthly, payable to Chairman of Committee, for such sums as may be required to meet the outlay as the work progresses. They have much pleasure in congratulating the inhabitants of the County, on the comparatively light character of the Criminal Calender, only five cases having come before them, and those for minor offences, and they are not without hope that when the Gaol is put in such a state of repair and efficiency as is now contemplated by the County Council, so that all reasonable hope of unlawfully escaping will be precluded, that crime will still further diminish. That the balance of the indebtedness of the said Peti- tioners, up to the first day of May, 1868, be ascertained, and that the same be payable in eight equal annual installments with interest on the whole principal sum unpaid annually from that date, the first of such installment of principal to fall due on the first day of May, 1870, and that payment thereof be secured by a Mortgage upon the remaining 1750 acres of land held by them (in the name of Mr, Watkins), and that all taxes now unpaid on all the said 3050 acres of land form part of such indebtedness, and be included in such mortgage; but that the settlement duties on these last mentioned lands be required to be performed by Covenant in such mortgage as now subsisting. 3. That the Petitioners be granted the privilege, free of charge, to construct and use tramways for the transportation of peat or other material on all roads and roadways belonging to this Council, the public travel thereon, neverthe- less, not to be obstructed or hindered by such tramways. 4. Is of lots 2 and 4 in the 4thCon. of Wain- fleet, in all. .800 acres at $6 per acre. The S. of 1 in the 3rd and S1 in the 4th... .200 do $10 do 1000 acres. The above purchase dates 4th December, 1865, upon which one-fifth has been paid. The balance, 1650 acres, was pur- chased 15th March, 1866, and one-sixth paid thereon, and comprises Lots, viz: Nof 5 in 3rd and S of 3 in 4th 200 acres at $20 per acre. Ss of 2, 3, 4, 5, 6, 7, 8 and 9, and Ns of 8 and 9, all in the 3rd Con., Wainfleet....... 1000 acres at $10 per acre. The whole of 9 and N s of 7 and 8 in the 2nd Con., Wainfleet 450 acres at $5.50 do 1650 acres. Your Petitioners and the aforesaid Watkins (to whom these lands are transferred, and in whose name they now stand and who holds the same in trust for the equal benefit of himself and each of your petitioners) have paid the County the first instalment thereupon amounting to about $4,100, and have also paid for transfers, registration fees and other expenses connected therewith at least $400 more. Of the principal sun remaining unpaid, two instalments are now due in addition to the interest already accumulated thereupon. Independent of the foregoing sums your petitioners have also paid for the 400 acres before referred to, and this added to the sums already paid the County, together with the various expenses incurred by them in making surveys, examining machines, traveling, &c., &c., now amounts in gross to something over Seventeen Thousand Dollars. The object your petitioners have had in making this very large �12 outlay has been to manufacture the peat contained in these lands into fuel, and being very sanguine of ultimate suc- cess, they have, during the past two years, devoted the greater portion of their time, besides spending the amount above stated, in order to secure success in this matter. And your petitioners have no doubt if this their enterprize had been successful, it could not have failed to have bestowed great and lasting benefit on the County of Welland as well as on themselves. Your Petitioners having, as aforesaid, tried various means both in the shape of getting up companies and otherwise, and in every other available way with which they are ac- quainted, have endeavored to raise the monies necessary for working capital and to pay for these lands, and after hav- ing repeatedly failed in securing a sufficient amount to do both, that is to work and pay for the lands at the prices agreed upon, have come to the conclusion to appeal to your Honorable body for such relief as you may feel disposed to grant in the premises, trusting that you will, after careful- ly considering the case of your petitioners, feel inclined to grant them what they ask, and thus enable them to go on and develope these lands by which the County will, in the opinion of your Petitioners, ultimately reap far more bene- efit than if the matter is left in its present position. Your Petitioners have been very unwilling to make any application to your honorable body for relief in this matter, and would not now do so, provided they had available means of their own at command, but as is herebefore shown, Seventeen Thousand Dollars, is already invested and in order to get the Fifty Thousand Dollars working capital which they require, they have agreed to deposit as security in the Bank subject to the order of the Directors of the Company they have now formed, the further sum of Twenty-five Thousand Dollars in securities, in order to guarantee the Stock- holders 12 per cent. on their investment, this being the case it is useless for them to think of proceeding unless some arrangement can be effected with your honorable body in regard to the amount now over due you on these Lands. �13 Before proceeding further we wish to state some amongst others of the reasons and causes to which we attribute our failure thus far: 1st. The high price agreed to be paid for the Lands. 2nd The restrictions placed upon the same in the shape of settlement duties and taxes. 3rd. The amounts and interest now overdue on the same. 4th. The tightness of the Money market. 5th. The nature of the business about to be entered upon, it being comparatively new and untried. 6th. The large amount of capital that must necessarily be expended before the experiment of converting the Peat on these lands, into a good merchantable fuel, at a price that will compare favorably with Wood or Coal, and in such a way that it will leave a fair profit upon the outlay incurred facts which can only be determined by actual trial and working, and which may result either in large profits or immense losses. 7th. The almost complete failure of all similar enterprizes (viz: the manufacture of Peat Fuel) in the United States during the past 2 years. 8th. The very great difficulty of raising Money for anything new or speculative in Canada, either by public or private enterprize, rendered still more difficult by the recent extensive failures of such schemes in the Oil region. Your Petitioners therefore pray, that the claims that the County now have upon the said Lands and the incumber- ances thereupon, may be arranged and adjusted in such a manner so as not to stand in the way of their develop- ment and desire that a settlement of the same may be made and the whole matter placed upon such a basis as will enable your Petitioners to go on and work these lands by means of a Company which they have formed on the basis of $50,000 working capital, a sum which they deem requisite and necessary to expend in order to thoroughly test this matter, and which amount it is impossible to get so long as the County holds these Lands in their present po- sition, as no persons or Company would-neither would it �14 be advisable to ask them to invest their means in operating upon these Lands until some adjustment of the difficulties before pointed out is arrived at, and as your Petitioners are averse to losing the amount they have already expended, and as they cannot obtain money from others without a guarantee, and as they cannot now see any other feasable way of raising the sum they require for working capital &c., they have agreed as is shown in their prospectus) to guarantee to any person taking stock in their Company of 12 of the first year on the amount of their subscription, and to secure the payment of the same (if not realized from the operations on the Lands) they have agreed to place in some Bank in this Dominion, $25,000 in securities which will be liable to be sold as the Directors of the Company shall see fit, in order to pay any portion of such deficiency as may occur, and thus by these means have secured the promise of sufficient means to start with and ultimately ex- pect to get the full amount required. From the foregoing statement you will see that in addition to locking up our available means the onus of this enterprize still rests upon the shoulders of your Petitioners, and the losses that may arise in working the Bog should any occur, must in a great measure be borne by themwhile the Shareholders in the Company and the County will be the parties most benefitted in case of success. Your Petitioners therefore pray, That you will reduce the price of some portions of the Lands previously named, and that such deduction shall date back to the time said Lands were purchased from the County by us. That you will throw off all Interest and Taxes on all the Lands herein before mentioned as belonging to us, to-wit: On 3050 acres up to the date hereof, that you will do away with and make null and void the restrictions and settlement duties (more full set forth in your Deeds) on the said Lands, as these will be more than counterbalanced by large expenditures on some portions of the said property. That you will give us the right of Roads such as may be neces sary to lay our Tramways &c., upon That you will clean �15 out the Ditches running through our property to their ori- ginal depth. That you will grant us the privilege of selecting from the unsold Lands of the County, such other Lands as we may require for the purposes of erecting buildings &c., thereupon, and such as may be necessary for the successful working of our business at a price not to exceed Five Dollars per acre,and on the same terms of payment as may be agreed upon with regard to the Lands we now have, and to grant us a reasonable time to select the same, such time not to exceed two years from the date hereof. Or to make the matter plainer, as far as the amount or reduction we ask is concerned, we wish the Lands bought by us from the County to be placed at the following figures viz : 800 acres at $6 per acre, to be reduced to $5 per acre. 450 acres at $5 50 to be reduced to $5. 200 acres bought at $20 to be reduced to Five Dollars per acre. 1200 acres bought at $10 to be reduced to Five Dollars per acre. The whole to date back to the time of the original pur- chase, and the interest upon the whole 3050 acres to be thrown off up to this date. By placing the matter in this shape we shall be enabled to raise working capital and test the matter. The relief asked for if granted should be made conditional upon our carrying out our scheme as laid down in our prospectus, and shall be of no effect unless we do so. He stated that, in all probability, the Inspector of Prisons for Ontario would be in attendance at this Session, to explain his views with reference to Gaols, and to confer with the Council on the subject of repairs to the Gaol of this County. Failure of He also mentioned that the parties claiming to have been Indictment Brown's Bridge aggrieved by the action taken by Council at the June Ses. sion, on the subject of Brown's Bridge, had been before the Grand Jury at the last Assizes, with a view to get the County indicted, but that the application for indictment failed. Temporary He further explained that he and the Treasurer had, since Loan. the last Session, under authority of the Resolution in that behalf then adopted, negotiated a temporary loan of $8,000 for the general purposes of the County. Letter from Brown and Hamilton in reference to Mrs. Loesch's claim. The Warden went on to say, that during the interim, since the June meeting, he had received a letter from Messrs. Brown & Hamilton, Barristers, St. Catharines, in be- half of Mrs. Charles Loesch, threatening legal proceedings for an alleged trespass on her Lands, in the construction of the "Junction Tap Drain," but that they had been induced to delay action until after this present Session of the Council. Treasurer's Sureties. With reference to the Resolution of Council of June, 1867, authorizing the Warden and Clerk to accept sureties for the County Treasurer, in lieu of Richard H. Kirkpatrick, Esq., who by reason of having removed from the County, had expressed a desire to be relieved, he stated that Mr. McGlashan had placed in his hands the Bond of Emanuel Winter Fares, Esq., of Humberstone, for $1,250, and the Bond of Jonas Steele, Esq., of Pelham, for the like sum, and that he and the Clerk had in the meantime, accepted those parties, but that it remained for the Council to ap- prove or otherwise, as to them might seem prudent, and he brought this part of his address to a close by laying on the Table the Bonds referred to. The Warden further mentioned that an ejectment suit �5 had been instituted by the County against the Grand Action of Trunk Railway Company, to recover pay for the County Ejectment County against Lands occupied by them at Port Colborne, which it was theGrand expected would have been tried at the Autumn Assizes in Trunk R. R. this County, but the County Solicitor, Mr. Raymond, found it necessary to obtain some documentary evidence from the Seat of Government, and therefore countermanded the notice of trial which had been given; and in relation to this part of his subject, he laid on the Table a good deal of correspondence between the Clerk and Solicitors, and others, touching the matter. AN ACT to confirm a By-Law of the Corporation of the Town- ship of Crowland, for the closing up of the original allowance for Road between Lots 26 and 27, and the Gore thereof in 7th Concession of Crowland. WHEREAS the Corporation of the Township of Crowland did on the 25th day of April, A. 1). 1868, pass a certain ByLaw intituled "A By-Law closing up the Road Allowance between Lots Nos. 26 and 27, and the Gore thereof, in the 7th Concession of Crowland, and authorizing the Reeve of said Township to sell the same to one of the parties having land adjacent thereto, which By-Law is in the following words and figures: Whereas, Samuel D. Woodruff and others, have by their Petition, represented that the Road Allowance between Lots Nos. 26 and 27, and the Gore thereof, in the 7th Con; cession.of Crowland, is not required for the public use, or for the purposes of a highway. And Whereas, due notice has been given to all parties concerned in regard to the closing up of the said Road as required by the Municipal Laws of this Province. And whereas, by the closing up of the said Road neither public nor private interests would suffer, whilst the Municipality would be benefited to the extent of the amount received from the sale of said Lands. Be it therefore Enacted by the Corporation of the Town- ship of Crowland, constituted and assembled under and by C �18 virtue of the Municipal Laws now in force in the Province of Ontario, and it is hereby enacted by the authority of the same, that from and after the passing of this By-Law, and after its confirmation by the Corporation of the County of Welland, the said Road Allowance shall be, and the same is hereby declared to be closed up and the right of the public to travel thereon shall forever cease, and terminate: And further, that the same be sold to Samuel D. Woodruff, Esquire, being the party whose lands adjoin the said Lands on each side thereof, at and for the price or sum of Eight Dollars per acre. And be it further Enacted by the authority aforesaid, that the Reeve of this Township be, and he is hereby author- ized and empowered for and in behalf of this Corporation, to convey the said Road Allowance to Samuel D. To the Warden and Councillors for the County of Welland in Council Assembled: The Committee on Roads and Bridges, beg leave to make this their First Report. The Bridge known as "O'Reilly's Bridge," over the River Welland, was injured by Hoover's Scow in June last. Hoover and others were prosecuted and damages awarded. Hoover appealed, and Magistrate's conviction was sustained by County Judge. The repairing of the Bridge was done by George Burke, under direction of Peter Beckett, Esq., one of the Bridge Committee, at an expense of $57 50. Your Committee recommend the said sum being paid, and the Warden issue his cheque in favor of George Burke for the said sum of $57 50. All of which is respectfully submitted. EDWARD LEE. To the Warden and Councillors for the County of Welland in Council Assembled: The Committee on Roads and Bridges beg to submit a Second Report. The Bridge over the Welland River, called O'Reilly's Bridge, was thrown down by a Scow belonging to Mr.. Minnis, the damages were appraised at $90, and legal steps taken by S. S. Hagar, Esq., against Minnis. paid $100, the repairs cost $75 87. Minnis has Your Committee recom- mend the Warden's cheque being issued in favor of T. W. Hooker in payment of said repairs. Your Committee beg to call the attention of the Council to the fact that O'Reilly's Bridge is becoming unsafe, and that any large amount of expenditure in repairs would be a waste of money, and recommend that the necessary steps be taken by the Council for the construction of a new Bridge the present winter or immediately after opening of navigation. Your Committee are informed by the Reeves of Wil- loughby and Crowland, that the Montrose Bridge is in a dangerous condition, and in all probability will require a new Swing. Your Committee recommend the Reeves of Willoughby, Stamford and Crowland, to employ a competent person to examine the Swing and other necessary repairs, and report the facts to this Council at its First Ses- sion in January next. The construction of the new Tap Drain, known as 'The Junction Tap,' for which a Contract was entered into with William Brown, at June completed Session of Council, is not yet Mr. Brown has, from the beginning, and is at the present time, pushing the work forward as fast as possible, having about twenty men at work, Mr. Brown in- forms your Committee it will take about six weeks or two months to complete the work. The sum of $1,200 has been paid to Mr. Brown to apply on his contract in part payment. In consequence of the large outlay in constructing the above new Tap, no further improvement or expenditure on any of the County Drains was done the past season. Your Committee find the Back Ditches, North and South of the Feeder, as well as the Marshville Tap, insufficientfor the wants of the inhabitants. All of which is respectfully submitted. The Gaoler informed them that he had lately entered upon the duties of his office, and that he had examined the books and papers in his office, but had found no Statement of the Prison property that he intended to take an inventory in a few days, and would inform your Committee when he had it completed. Your Committee informed the Gaoler that if he needed any supplies above those contracted for, that he was to call on Mr. Hooker, one of the members of your Committee, and obtain an order for the same. The amount of Supplies ordered by the Committee, including repairs to County Building for the year, did not exceed the sum of $60. There is but one of the Offices in the Court House rented at present, and your Committee would recommend that in future none of the Offices in the County Building be let; as in the opinion of your Committee, the County suffers a loss thereby. To the Warden and Councillors for the County of Welland in Council Assembled: The Special Committee on Common Gaol Supplies beg leave to submit their Report. Having gone carefully over the Gaol Accounts for nine months of the present year, they think that some change is required in the management of the Gaol Supplies; as in their opinion great extravagance prevails, or the prisoners get better fare than the Regulations require. We may instance the account for Beef in three months exceeding the most liberal prison fare regulations by nearly 400 pounds for the number of prisoners confined during those months. The use of Molasses we think has been very large-say for the months of April, May, June, July, August, September, 115 gallons-in some of these months giving an allowance of nearly 1 pints for each prisoner per day. Coal Oil has been largely used. Repairs to cooking and other utensils has been very large, and two accounts amounting to $172 for stoves, repairs, tin and copper ware, &c. The Committee on Gaol Supplies, appointed by your Council for the year, know only of their being asked, and having ordered from $50 to $60 of the items, and only approve of the articles ordered by their knowledge and consent. D �26 Your Committee find that for food only, it costs the County two dollars and ten cents a week for each prisoner, and according to prison fare regulations, the cost should be about seventy cents per week each. In order to prevent the getting of articles on the County credit, unless approved by the Committee appointed each year by the Council to manage Gaol Supplies, your Special Committee would recommend that a notice be served upon the County Treasurer not to pay any account in future for such supplies, unless signed by the Warden or a majority of the Gaol Committee, as your Committee think that some one should be responsible to the Council for this expenditure which we have no control of at present, as the accounts are all paid before the Gaol Committee or Council have an opportunity of seeing or approving the items. We would also once more call attention to the imperfect Audit of the Administration of Justice account for the County, the Warden, as representing the County interest at that Board, never having received notice to attend, and the Audit made without the County being represented, and hope this will be remedied. To the Honorable the Legislative Assembly of the Province of Ontario in Parliament Assembled: The Memorial of the Corporation of the County of Welland in Council Assembled, HUMBLY SHEWETHThat as the "Assessment Act of Canada" now stands, there is not any right of appeal from the decision of the Judge of the County Court in cases where there has been an appeal to him from the Courts of Revision. That there have been cases in which the want of such right of appeal has been the cause of great wrong and loss To two of which cases, as illustrating what your petitioners represent, your petitioners beg leave to draw your attention. The Assessor of the Municipality of the Town of Clifton for the present year assessed "The Niagara Falls Suspension Bridge Estate in Company," as the owners of certain Real the said Town of the value of Two Hundred Thousand Dollars, which amount was afterwards, on appeal to the Court of Revision of the said Town, reduced to the sum cf One Hundred and Fifty Thousand Dollars; and the said Company appealing from the decision of the said Court of Revision to the Judge of the County Court of this County of Welland, the said Judge further reduced the �28 last mentioned sum to the sum of One Thousand Dollars, although the said Company were the owners of real estate which was assessed as aforesaid of the value at the least of One Hundred and Fifty Thousand Dollars. The Assessor of the Municipality of the Township of Humberstone for the present year, assessed "The Welland Railway Company" as the owners of the Elevator at Port Colborne, in the said Township of Humberstone, of the value of Ten Thousand Dollars, which amount was afterwards, on appeal to the Court of Revision of the said Town- ship, confirmed: and the said Company appealing from the decision of the said Court of Revision to the Judge of the County Court of this County, the said Judge struck the whole amount from the Assessment Rolls of the said Township, although the said Elevator was of the value at the least of Ten Thousand Dollars. In the adjoining County of Lincoln, the said Welland Railway Company are the owners of an Elevator similar to that at Port Colborne, for which they have been assessed for the value of over Twelve Thousand Dollars, and in a similar appeal to the County Judge of Lincoln, the Assessment was sustained. That there being no right of appeal from the said decisi ons of the said Judge of this County, great wrong has been done to the said Town of Clifton and Township of Humberstone, and thereby to this County of Welland, in the opinion of your Petitioners. Your Memorialists, therefore, humbly pray that such amendments may be made to the Assessment Laws of this Province as will enable parties deeming themselves aggrieved by the decision of the County Judge, in cases under the said Act, to appeal from such decision to some higher authority or tribunal. MAY IT PLEASE YOUR WORSHIP, We, the undersigned, the Warden and Councillors ofthe County of Welland, beg to welcome you and the distinguished individuals who accompany you among us. This being a rural County, and its inhabitants being principally engaged in Agriculture there is very little in the way of elegant buildings, or costly edifices, particularly here in the interior to attract, or even to interest, strangers; but though we ourselves cannot boast of populous Towns, nor make pretension to an architectural display, we believe that we have among us that, which when properly deve- loped, and rightly applied,may lead to the peopling of large Cities, and the building up of vast structures. In the great economy of life, next to cheap Bread and an ample supply, will rank cheap Fuel, and an abundance of it. Not only the every-day wants of a community, but the growth of Manufactures, the extension of Commerce, and the spread of Civilization, as also the fostering of the Arts and Sciences, all depend mainly upon cheap Fuel and an abundance of it; and we have reason to believe that the extensive Beds of Peat which you are now about to visit, are sufficient to furnish to the whole country not only cheap Fuel, but an abundance of it for years, perhaps cen- turies to come. �32 In this connection, it is our pleasing duty to state to your Worship that, though this great Mine of Wealth is in our midst, but for the enterprise and indomitable perseverance of one of your number a worthy member of your Board. -the whole might have remained for ages of the future, as it has been for ages in the past, a barren waste; and this fact makes our welcome to you all the more hearty, and will ever cause our people to feel a deep interest in the welfare and prosperity of your proverbially neat and thriving City. That this great enterprise is worthy of both moral and material support we are fully convinced, and we earnestly trust that this day's proceedings may so strengthen and encourage your townsman that his undertaking will, beyond al peradventure, henceforward be a 'complete success'; and that this interchange of civilities which you have so generously initiated, may lay the foundation for like amenities hereafter, and for an enlarged and profitable commercial intercourse between the people of our respective localities.
